Welcome to WHISPERING WINDS. These Terms and Conditions (“Terms”) govern your use of the website https://gohivekr.com/ (the “Website”) and all purchases made through it. Please read them carefully before placing an order. By using the Website or placing an order, you agree to be bound by these Terms.

2. Scope of These Terms
2.1. These Terms apply to all orders placed through the Website and to all contracts for the sale of goods concluded between us and you, the customer.
2.2. If you are purchasing as a consumer (a natural person acting outside their trade or business), nothing in these Terms limits any rights you have under applicable consumer protection law of Czechia and the European Union.
3. Products
3.1. We sell loose-leaf teas, tea accessories, and related products. Product descriptions, images, and tasting notes on the Website are provided in good faith and are as accurate as we can make them.
3.2. Tea is a natural agricultural product. Minor variations in appearance, aroma, and taste between harvests and batches are normal and do not constitute a defect.
3.3. Product images are illustrative. Packaging design may vary.
4. Orders and Contract Formation
4.1. Placing a product in your cart and submitting an order constitutes an offer to purchase. Our automated order confirmation email acknowledges receipt of your order but does not yet constitute acceptance.
4.2. The contract between us is concluded when we send you a confirmation that your order has been accepted or dispatched, whichever comes first.
4.3. We reserve the right to refuse or cancel an order in cases including, but not limited to: unavailability of goods, obvious pricing errors, or suspected fraud. If payment has already been made, it will be refunded in full without undue delay.
5. Prices and Payment
5.1. All prices on the Website are stated in [CURRENCY] and include VAT where applicable. Shipping costs are shown separately before you complete your order.
5.2. We accept the payment methods displayed at checkout. Payment is due at the time of ordering unless stated otherwise.
5.3. In the event of an obvious pricing error, we are not obliged to deliver the goods at the incorrect price. We will contact you to either confirm the order at the correct price or cancel it with a full refund.
6. Delivery
6.1. We deliver to the countries listed at checkout. Estimated delivery times are indicative and begin from dispatch, not from the order date.
6.2. Risk of damage to or loss of the goods passes to you when you (or a person designated by you) take physical possession of the goods.
6.3. If a shipment arrives visibly damaged, please note the damage with the carrier where possible and contact us at [email protected] promptly so we can resolve it.
7. Right of Withdrawal (14 Days)
7.1. If you are a consumer in the European Union, you have the right to withdraw from the contract within 14 days of receiving the goods, without giving any reason.
7.2. To exercise this right, notify us within the 14-day period by an unambiguous statement (e.g., an email to [email protected]). You may use the model withdrawal form provided by law, but it is not obligatory.
7.3. You must return the goods to us without undue delay and no later than 14 days from the day you notified us of the withdrawal. You bear the direct cost of returning the goods unless stated otherwise.
7.4. We will refund all payments received from you, including standard delivery costs, without undue delay and no later than 14 days from the day we are informed of your withdrawal. We may withhold the refund until we have received the goods back or you have supplied proof of having sent them.
7.5. Exceptions: In accordance with applicable law, the right of withdrawal does not apply to goods that have been unsealed after delivery and cannot be returned for reasons of health protection or hygiene — this includes tea and other food products whose protective packaging has been opened. Unopened products in their original sealed packaging may be returned normally.
7.6. You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature and characteristics.
8. Defective Goods and Complaints
8.1. We are liable to consumers for defects in accordance with applicable law. If the goods are defective upon receipt, you may exercise your rights within the statutory period.
8.2. For food products such as tea, claims regarding quality must be raised before the expiry of the best-before date and, in the case of perishability or storage-sensitive defects, without undue delay after discovery.
8.3. To make a complaint, contact us at [email protected] with your order number, a description of the issue, and photos where relevant. We will respond without undue delay and resolve justified complaints by replacement, price reduction, or refund as appropriate.
8.4. Defects caused by improper storage or handling after delivery (e.g., exposure to moisture, strong odours, direct sunlight) are not covered.
9. Food Information and Allergens
9.1. Ingredient and allergen information is provided on product pages and packaging. If you have allergies or dietary restrictions, please review this information before ordering and contact us at [email protected] with any questions.
9.2. Our teas may be processed in facilities that also handle other botanical products. Any relevant cross-contamination information is stated on the product page or packaging.
10. Intellectual Property
All content on the Website — including text, product descriptions, photographs, graphics, and the WHISPERING WINDS name and logo — is our property or used under licence, and may not be reproduced or used commercially without our prior written consent.
11. Personal Data
We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable national law. Details are set out in our Privacy Policy available on the Website.
12. Limitation of Liability
12.1. Nothing in these Terms excludes or limits our liability where such exclusion or limitation would be unlawful, including liability for death or personal injury caused by negligence or for intentional misconduct.
12.2. To the extent permitted by law, we are not liable for indirect or consequential losses arising from the use of the Website or products, and our total liability in connection with any order is limited to the price paid for that order.
13. Out-of-Court Dispute Resolution
13.1. If you are a consumer and a dispute between us cannot be resolved directly, you have the right to out-of-court dispute resolution with the competent consumer protection authority in Czechia — the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz).
13.2. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
14. Governing Law and Jurisdiction
14.1. These Terms and all contracts concluded under them are governed by the laws of Czechia, without prejudice to mandatory consumer protections of the country of your habitual residence.
14.2. Disputes shall be resolved by the competent courts of Czechia, unless mandatory law provides otherwise for consumers.
15. Changes to These Terms
We may update these Terms from time to time. The version in force at the time you place your order applies to that order. The current version is always available on the Website.
